Israel's Voluntary Disclosure Program Fell Billions Short

Israel's year-long voluntary disclosure procedure closed with NIS 152.6 million in tax, far short of its NIS 2-3 billion target, and crypto investors barely participated. What the shortfall means for the next wave of enforcement.

Israel's Tax Authority closed its 2026 voluntary disclosure program on August 31, 2026. Disclosed capital reached NIS 1.89 billion, and estimated tax came to roughly NIS 152.6 million. The state had projected NIS 2 billion to NIS 3 billion. Only 203 requests came from crypto holders, the group the program was built to reach.

How Much Did Israel's Voluntary Disclosure Program Actually Collect?

Israel's Tax Authority ran the procedure for a full year before it closed on August 31, 2026. Disclosed capital reached about NIS 1.89 billion, against an original state target of NIS 2 billion to NIS 3 billion. Estimated tax came to roughly NIS 152.6 million.

I have spent years representing clients before Israeli tax and enforcement authorities in undeclared-asset matters, and I read this gap as a structural signal, not an isolated miss. The shortfall shows how the program was designed and how its intended targets, crypto holders, actually perceived it.

Why Didn't Crypto Investors Use the Window?

Crypto holders filed only 203 voluntary disclosure requests, reporting about NIS 482.5 million in capital and NIS 51 million in estimated tax. The State Comptroller's report that prompted the program had pointed to roughly NIS 3 billion in uncollected crypto tax potential. The response covered only a small share of that estimate.

Many crypto investors hold assets through international exchanges, non-custodial wallets, and digital identities that are harder to trace than a conventional bank account. A large share are betting the Tax Authority will not reach them, and are choosing relative anonymity over a time-limited amnesty. That bet is getting worse. International information-sharing rules are closing in on crypto exchanges. That includes the expanded Common Reporting Standard and the European Union's DAC8 standard, alongside a widening wave of global regulation. Anyone who skipped this window may face a criminal investigation within a year or two rather than a resolved administrative process.

Exchanges and stablecoin issuers already have the power to act unilaterally. Tether alone froze $1.26 billion in USDT in 2025. Appealing a frozen wallet is a separate legal fight, covered in my guide to appealing frozen crypto wallets.

Which Assets Actually Drove the Disclosures?

Rental income, not crypto, produced the highest response rate: 324 requests, NIS 358.2 million in disclosed capital, and NIS 32.3 million in estimated tax. Foreign bank accounts followed with 197 requests, NIS 623.1 million in capital, and NIS 41.9 million in tax.

The pattern points to a program that worked mainly on people who were already exposed. Property owners and holders of identifiable bank accounts understood the Tax Authority would eventually get the information anyway. The original target population, crypto gains, is the group that stayed away.

What Happens After a Failed Amnesty Window?

Israel ran three earlier voluntary disclosure procedures, in 2011-2012, 2014-2016, and 2017-2019. Together they handled about 9,000 cases and collected roughly NIS 5 billion in tax. Each one was followed by a wave of intensified enforcement built on the information and infrastructure the procedure itself had generated.

I expect the same pattern here, now aimed squarely at crypto. Having seen voluntary enticement fail with crypto, the state is likely to turn to more coercive tools in the coming years:

  • Targeted investigations into undeclared crypto gains
  • Expanded international cooperation with foreign tax and enforcement bodies
  • Direct information demands from exchanges serving Israeli clients

That enforcement push lines up with a separate proposal to tighten Israel's tax residency test to a fixed day count. Both point the same direction: the state is closing the gaps that let taxpayers stay ambiguous about their exposure.

The Takeaway

Anyone who has not yet disclosed assets or gains, from crypto, a foreign account, or another source, faces a clear choice. This window will not be the last one. But the next procedure will arrive with far more information already in the authorities' hands, and a higher criminal risk for anyone who waited.

Individualized legal advice before any approach to the Tax Authority matters. The line between a disclosure that helps and one that creates new criminal exposure can be thin.

הפער הזה אינו מקרי. משקיעי קריפטו רבים פועלים דרך בורסות בינלאומיות, ארנקים לא-משמורניים וזהויות דיגיטליות שקשה יותר לאתר מאשר חשבון בנק קלאסי. חלקם הגדול פשוט מהמר על כך שהרשות לא תגיע אליהם, ומעדיף לשמור על אנונימיות יחסית על פני חסינות פלילית מוגבלת בזמן. זו הימור מסוכן. מנגנוני שיתוף מידע בין-לאומיים כגון CRS המורחב ותקן ה-DAC8 האירופי, לצד מגמת רגולציה גלובלית ההולכת ומתגברת על בורסות קריפטו, הופכים את האנונימיות הזו לאשליה שתפוג במוקדם או במאוחר. מי שבחר לא לנצל את החלון שנפתח בפניו כעת עלול למצוא עצמו, בעוד שנה או שנתיים, מול חקירה פלילית של ממש ולא מול הליך מנהלי מרוצה.

דיווחים משכר דירה וחשבונות בחו"ל: התמונה המלאה

מעניין לא פחות הוא שהתחום שבו נרשמה ההיענות הגבוהה ביותר לא היה כלל הקריפטו, אלא הכנסות משכר דירה: 324 בקשות, הון מדווח של כ-358.2 מיליון שקל ומס משוער של כ-32.3 מיליון שקל. גם חשבונות בנק בחו"ל תפסו נתח משמעותי, עם 197 בקשות, הון מדווח של כ-623.1 מיליון שקל ומס משוער של כ-41.9 מיליון שקל. התמונה המצטברת מלמדת שהגילוי מרצון "עבד" בעיקר על אוכלוסייה שכבר הייתה חשופה יחסית: בעלי דירות ובעלי חשבונות בנק מזוהים, שהבינו כי מדובר בשאלה של זמן עד שהמידע יגיע לרשות בין כה וכה, ולא על אוכלוסיית המטרה המקורית של רווחי הקריפטו.

מה זה אומר לגבי האכיפה הבאה

מניסיוני בייעוץ ובהגנה במקרים של הון בלתי מדווח, כשל בקנה מידה כזה אינו סוף פסוק. זוהי נקודת מפנה. נהלי גילוי מרצון קודמים, שהופעלו בשנים 2011-2012, 2014-2016 ו-2017-2019, הובילו במצטבר לטיפול בכ-9,000 תיקים ולגביית מס בסכום כולל של כ-5 מיליארד שקל, ולאחר כל אחד מהם ראינו גל אכיפה מוגבר שהגיע דווקא בעקבות המידע והתשתית שהצטברו במהלך הנוהל עצמו. יש להניח שהמדינה, שנוכחה כעת כי הפיתוי מרצון לא הביא את שוק הקריפטו להיחשף כמצופה, תפנה בשנים הקרובות לכלים כפייתיים יותר: חקירות ממוקדות, שיתופי פעולה בין-לאומיים מוגברים עם רשויות מס וגופי אכיפה זרים, ודרישות מידע ישירות מבורסות הקריפטו הפועלות מול לקוחות ישראלים.

ללקוחות שטרם דיווחו על הון או רווחים, בין אם ממקור קריפטו, חשבון בחו"ל או כל מקור אחר, המסר הוא ברור: החלון שנסגר עתה לא יישאר החלון האחרון, אך כל נוהל עתידי כזה יבוא על רקע ידע רב יותר שכבר מצוי בידי הרשויות, ולכן גם על רקע סיכון פלילי גבוה יותר למי שבחר להמתין. הטיפול המושכל בסיטואציה הזו, בין אם באמצעות ליווי לקראת נוהל עתידי ובין אם באמצעות בחינת חשיפה קיימת, מחייב ייעוץ משפטי פרטני בטרם כל פנייה לרשות, שכן הפער בין הצהרה מיטיבה לבין הצהרה שמייצרת חשיפה פלילית נוספת יכול להיות דק מאוד.
